Senate Bill 2842

AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS, UPON TAKING OWNERSHIP OF A PRIVATE STREET OR ROADWAY, TO ASSESS EACH HOMEOWNER FRONTING THAT STREET BASED ON THE HOMEOWNER'S PRO-RATA PLATTED LOT AREA; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Upon taking ownership of a private street or roadway, the board of supervisors, in its discretion, may assess each homeowner along that street or roadway an amount necessary to improve the street to county standards.  However, such assessment shall be calculated based on the homeowner's pro-rata platted lot area, rather than the homeowner's pro-rata frontage on the street. 

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2011.
