AN ACT TO CREATE THE CERTIFIED INVESTIGATOR PROGRAM FUND IN SUPPORT OF THE CERTIFIED INVESTIGATOR PROGRAM OF THE MINIMUM STANDARDS BOARD; TO IMPOSE A SURCHARGE ON CERTAIN VIOLATIONS; TO PROVIDE FOR DEPOSIT OF THE FUNDS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  In addition to any other monetary penalties and other penalties imposed by law, there shall be an additional surcharge of One Dollar ($1.00) on each person upon whom a county, justice or municipal court imposes a fine or other penalty for any misdemeanor other than offenses relating to vehicular parking or registration.  The surcharge shall be collected by the court and deposited as provided in subsection (2) of this section.  The proceeds from the surcharge shall be deposited into the Certified Investigator Program (CIP) Fund.  One percent (1%) of the proceeds are to be retained by the Office of Public Safety Planning to defray the costs of administering the special fund.  Interest earned on the special fund shall remain in the fund and shall be used by the Office of Public Safety Planning to further defray the costs of administering the special fund.

     (2)  It shall be the duty of the clerk of the court to deposit the total amount of the surcharge on a monthly basis with the Department of Public Safety pursuant to appropriate procedures established by the State Auditor.

     (3)  There is established in the Department of Public Safety a special fund to be known as the Certified Investigator Program (CIP) Fund.  The purpose of the fund shall be to provide funding to enable the Board on Law Enforcement Officer Standards and Training to cover the costs of Certified Investigator Program training to state and local law enforcement agencies to the extent funds are available.  The fund shall be a continuing fund, not subject to fiscal-year limitations, and shall consist of:

          (a)  Monies appropriated by the Legislature for the purposes of funding the Certified Investigators Program;

          (b)  The interest accruing to the fund;

          (c)  Monies received under the provisions of subsection (1) of this section;

          (d)  Monies received from the federal government;

          (e)  Donations; and

          (f)  Monies received from such other sources as may be provided by law.

     (4)  The CIP program shall be offered by the Board on Minimum Standards and Training and shall consist of not less than four hundred (400) hours of detailed instruction about homicide investigations and related topics.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2012.
