AN ACT TO LIMIT THE AMOUNT OF COMPENSATION THAT MAY BE PAID BY AN AGENCY TO AN INDEPENDENT CONTRACTOR WHO IS RECEIVING A RETIREMENT ALLOWANCE FROM THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) If an agency contracts with a person to provide services as an independent contractor and the person is receiving a retirement allowance from the Public Employees' Retirement System, the annual compensation paid to person for the service rendered under the contract shall not exceed twenty percent (20%) of the highest annual earned compensation that the person was paid while employed in a position covered by the Public Employees' Retirement System.
(2) As used in this section, the terms "agency" and "earned compensation" shall have the meaning ascribed to such terms in Section 25-11-103.
SECTION 2. This act shall take effect and be in force from and after July 1, 2011.
