Senate Bill 2930

AN ACT TO AMEND SECTION 99-37-13, MISSISSIPPI CODE OF 1972, TO SPECIFY GARNISHMENT OF TAX REFUNDS ISSUED BY THE STATE OF MISSISSIPPI AS A MEANS OF COLLECTING FINES AND COSTS ON WHICH A DEBTOR HAS DEFAULTED; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 99-37-13, Mississippi Code of 1972, is amended as follows:

     99-37-13.  A default in the payment of a fine or costs or failure to make restitution or any installment thereof may be collected by any means authorized by law for the enforcement of a judgment, including the garnishment of any refund of taxes issued by the State of Mississippi.  The levy of execution for the collection of a fine or restitution shall not discharge a defendant committed to imprisonment for contempt until the amount of the fine or restitution has actually been collected.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2019.
