Senate Bill 3104

AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF MADISON COUNTY, MISSISSIPPI, TO ALLOW GATES TO BE PLACED ON COUNTY ROADS FOR THE PURPOSE OF ENCLOSING A NEIGHBORHOOD IF THE GATE OPENS AUTOMATICALLY UPON APPROACH OF ANY MOTOR VEHICLE WITHOUT THE USE OF A KEY, CODE OR OTHER DEVICE; TO PROVIDE THAT SUCH GATES SHALL NOT BE CONSIDERED AN OBSTRUCTION TO THE ROAD OF THE TYPE THAT IS PROHIBITED BY SECTION 65-7-7; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Notwithstanding the provisions of Section 65-7-7, Mississippi Code of 1972, the Board of Supervisors of Madison County, Mississippi, is authorized and empowered, in its discretion, by order duly adopted and entered upon it minutes, to allow gates to be placed on county roads for the purpose of enclosing a neighborhood if the gate opens automatically upon approach of any motor vehicle without the use of a key, code or other device.  A gate placed on a county road pursuant to this section shall not be considered an obstruction to the road of the type that is prohibited by Section 65-7-7.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
