A BILL TO BE ENTITLED
AN ACT to confirm that north carolina law requires physician supervision of all nurses providing anesthesia services.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 90‑18(c) is amended by adding a new subdivision to read:
"(c) The following shall not constitute practicing medicine or surgery as defined in this Article:
…
(14a) The provision of anesthesia services by a nurse anesthetist, so long as the anesthesia services are provided under the supervision of (i) a physician licensed under this Article or (ii) a licensed dentist who is qualified to provide anesthesia services pursuant to G.S. 90‑29. A nurse anesthetist may provide local anesthesia under the supervision of a licensed podiatrist pursuant to G.S. 90‑202.2(a).

SECTION 2. G.S. 90‑171.20(7)e. reads as rewritten:
"§ 90‑171.20. Definitions.
As used in this Article, unless the context requires otherwise:
…
(7) The "practice of nursing by a registered nurse" consists of the following 10 components:
…
e. Collaborating with other health care providers in determining the appropriate health care for a patient but, subject to the provisions of G.S. 90‑18.2, not prescribing a medical treatment regimen or making a medical diagnosis, except under supervision of a licensed physician. A nurse anesthetist may provide anesthesia services only if the anesthesia services are provided under the supervision of (i) a physician licensed under Article 1 of this Chapter or (ii) a licensed dentist who is qualified to provide anesthesia services pursuant to G.S. 90‑29. A nurse anesthetist may provide local anesthesia under the supervision of a licensed podiatrist pursuant to G.S. 90‑202.2(a).

SECTION 3. This act is effective when it becomes law.
