A BILL TO BE ENTITLED

AN ACT to require disclosure to consumers that personal information collected by a business may be accessible by persons or businesses outside of the united states.

The General Assembly of North Carolina enacts:

SECTION 1.  Chapter 75 of the General Statutes is amended by adding a new Article to read:

"Article 8.

"Personal Information Protection Act.

"§ 75‑136.  Title.

This Article shall be known and may be cited as the "Personal Information Protection Act."

"§ 75‑137.  Required disclosure.

(a)        For purposes of this Article, the terms "business," "consumer," "person," and "personal information" have the same meaning as in G.S. 75‑61.

(b)        Any business that collects the personal information of a consumer shall not disclose that personal information to a third-party person or business located outside of the United States unless the business provides clear and conspicuous notice to the consumer, in writing or electronic form, that his or her personal information may be disclosed to a third-party person or business located outside of the United States. This notice shall be in addition to any other notice required to be provided by State or federal law and may be included on the same written or electronic form containing the other required notices.

(c)        A violation of this section is a violation of G.S. 75-1.1."

SECTION 2.  This act becomes effective October 1, 2013.
