A BILL TO BE ENTITLED

AN ACT to PROTECT the public from electrical malfunctions AT PUBLIC SWIMMING POOLS.

Whereas, Rachel Rosoff, a 17‑year‑old senior at Enloe High School, died on September 3 at the swimming pool where she was employed as a lifeguard; and

Whereas, Rachel was electrocuted and drowned when the swimming pool pump motor failed and a corroded wire prevented circuit breakers from tripping, resulting in the pool's water becoming electrified; and

Whereas, public swimming pools in the State are not currently required to install ground‑fault circuit‑interrupter protection on the electrical circuits providing power to the swimming pool pump motor; Now, therefore,

The General Assembly of North Carolina enacts:

SECTION 1.  Part 10 of Article 8 of Chapter 130A of the General Statutes is amended by adding a new section to read:

"§ 130A‑281.5  Pool electrical safety.

All public swimming pools shall, not later than 90 days after this section becomes law, ensure that the electrical circuit or receptacle providing power to the pool's pump motor includes ground‑fault circuit‑interrupter protection for personnel."

SECTION 2.  G.S. 130A‑282(a)(5) reads as rewritten:

"(5)      Operation and safety including water source, water quality and testing, fencing, water treatment, chemical storage, toilet and bath facilities, measures to ensure the personal cleanliness of bathers, safety equipment and other safety measures, including electrical safety as set out in G.S. 130A‑281.5, and sewage and other wastewater disposal."

SECTION 3.  This act is effective when it becomes law.
