A BILL TO BE ENTITLED

AN ACT to give adult care home and nursing home residents the right to receive written notice of the facility's professional liability insurance coverage and to require adult care homes and nursing homes to post information about their professional liability insurance coverage.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 131D‑21 is amended by adding a new subdivision to read:

"(18)    To receive at the time of admission written notice as to whether the facility maintains professional liability insurance coverage, and to receive during the stay written notice of any modification, termination, or nonrenewal of the facility's professional liability insurance coverage. Each facility that maintains professional liability insurance coverage shall include in the written notice required by this subdivision all of the following information:  the name, address, and telephone number of the insurer; the amount of coverage; the name of each facility covered under the policy; whether it is a claims‑made or occurrence policy; the amount of any deductible; and the policy period."

SECTION 2.  G.S. 131D‑24 is amended by adding a new subsection to read:

"(a1)     A copy of the written notice of professional liability insurance coverage required by G.S. 131D‑21(18) shall be posted conspicuously in a public place in all facilities."

SECTION 3.  G.S. 131E‑117 is amended by adding a new subdivision to read:

"(17)    To receive at the time of admission written notice as to whether the facility maintains professional liability insurance coverage, and to receive during the stay written notice of any modification, termination, or nonrenewal of the facility's professional liability insurance coverage. Each facility that maintains professional liability insurance coverage shall include in the written notice required by this subdivision all of the following information:  the name, address, and telephone number of the insurer; the amount of coverage; the name of each facility covered under the policy; whether it is a claims‑made or occurrence policy; the amount of any deductible; and the policy period."

SECTION 4.  G.S. 131E‑120 is amended by adding a new subsection to read:

"(a1)     A copy of the written notice of professional liability insurance coverage required by G.S. 131E‑117(17) shall be posted conspicuously in a public place in all facilities."

SECTION 5.  This act is effective when it becomes law.
