A BILL TO BE ENTITLED
AN ACT authorizing the joint legislative program evaluation oversight committee to direct the program evaluation division to study the contested case process Contained in Article 3 of chapter 150B OF THE GENERAL STATUTES in connection with provider appeals under the medicaid program.
The General Assembly of North Carolina enacts:
SECTION 1. The Joint Legislative Program Evaluation Oversight Committee shall include in the 2013‑2014 Work Plan for the Program Evaluation Division of the General Assembly a study of the contested case process for administrative review of agency determinations which have an adverse effect on Medicaid providers. The Program Evaluation Division shall include the following within this study:
(1) A review of the procedures set forth in Article 3 of Chapter 150B of the General Statutes to determine whether the procedures should be modified to streamline the process and reduce any case backlogs.
(2) Consideration of alternative methods of review other than the contested case process set forth in Article 3 of Chapter 150B of the General Statutes.
(3) A review of G.S. 108C‑12 to determine whether amendments to the law would improve the cost‑effectiveness and efficiency of the Medicaid appeal process.
SECTION 2. The Program Evaluation Division shall submit its findings and recommendations from Section 1 of this act to the Joint Legislative Program Evaluation Oversight Committee and the Joint Legislative Administrative Procedure Oversight Committee at a date to be determined by the Joint Legislative Program Evaluation Oversight Committee.
SECTION 3. This act is effective when it becomes law.
