A BILL TO BE ENTITLED

AN ACT to clarify the scope of the exemption from the occupational health and safety act general industry standard pertaining to Certain food processing facilities.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 95‑131 is amended by adding a new subsection to read:

"(h)       The Commissioner shall apply the exemption for agricultural operations from the general industry standard provided by 29 C.F.R. § 1928.1 to facilities for the processing of products that meet all of the following:

(1)        It is wholly owned by a bona fide farm. For purposes of this subdivision, "bona fide farm" shall be defined as in G.S. 153A‑340(b)(2).

(2)        It processes only agricultural products produced on the farm."

SECTION 2.  This act is effective when it becomes law.
