Short Title:      Lottery Funds for School Construction.

A BILL TO BE ENTITLED

AN ACT to direct that a portion of lottery revenues be allocated for k‑12 school construction based upon county need and ability to pay for school construction projects.

The General Assembly of North Carolina enacts:

SECTION 1.  There is created the Critical Public School Building Needs Fund to be administered by the Department of Public Instruction. The Fund shall be used to award grants to counties to assist with their critical public school building capital needs and shall be awarded based upon a county's need and ability to generate sales tax and property tax revenue.

SECTION 2.(a)  There is appropriated from the Education Lottery Fund to the Critical Public School Building Needs Fund the sum of twenty‑five million dollars ($25,000,000) for the 2016‑2017 fiscal year.

SECTION 2.(b)  In addition to the funds appropriated in subsection (a) of this section, if Senate Bill 728, 2015 Regular Session, becomes law, there is appropriated from the Education Lottery Fund to the Critical Public School Building Needs Fund the sum of twenty‑five million dollars ($25,000,000) for the 2016‑2017 fiscal year.

SECTION 3.  This act becomes effective July 1, 2016.
