This bill provides that if a cause of action is concealed, the period of time it is concealed shall not count against the time limitation for commencing the action.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Two

 

AN ACT relative to concealment of a cause of action.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Limitation of Actions; Concealment of Cause of Action.  Amend RSA 508:4 by inserting after paragraph II the following new paragraph:

III.  If a person who would be a party to a personal action under this section purposely conceals the cause of such action from the knowledge of the person entitled to bring the action, the period of time of the concealment shall not count in determining the time limitation for commencing the action.  

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill provides that if a cause of action is concealed, the period of time it is concealed shall not count against the time limitation for commencing the action.  The Judicial Branch expects there may be additional lawsuits filed that are not currently filed due to the lapse in statutes of limitations.  The Branch further expects it would receive additional motions and hold additional hearings to determine if the conditions set forth in the bill regarding statutes of limitations have been met.  While the total fiscal impact is indeterminable, the Judicial Branch anticipates such fiscal impact would be relatively minor.

 

It is assumed that any fiscal impact would occur after FY 2022.
