STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT applying the procedures of the eminent domain procedures act to cases of eminent domain concerning public utilities.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Procedure; Eminent Domain Cases Concerning Public Utility Facilities. RSA 371:1-a is repealed and reenacted to read as follows:

371:1-a Procedure. The public utilities commission shall apply the procedural provisions of RSA 498-A, the eminent domain procedure act, to all cases of eminent domain involving public utilities. The public utilities commission shall apply the provisions of this chapter to cases of eminent domain involving public utilities, unless the provisions of this chapter conflict with the procedural provisions of RSA 498-A, in which case the procedural provisions of RSA 498-A shall supercede the provisions of this chapter.

2 Effective Date. This act shall take effect January 1, 2013.
