AN ACT allowing the department of transportation to sell naming rights for certain structures.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT allowing the department of transportation to sell naming rights for certain structures.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Sale of Naming Rights. Amend RSA 228 by inserting after section 32 the following new section:
228:32-a Sale of Naming Rights.
I. The commissioner may issue a request for proposals (RFP) to sell naming rights for a particular structure, including but not limited to bridges, overpasses, and exits, to the highest bidder. All contracts for the sale of naming rights shall be approved by the governor and council and the proceeds of such sales shall be deposited in the highway fund.
II. The purchaser of a naming right shall pay the cost of erecting, maintaining, and removing signage as well as an annual fee as determined by the proposal.
III. The term of any contract for naming rights shall not exceed 25 years, and may be shorter at the discretion of the commissioner. The purchaser of a naming right shall have an option of early termination.
IV. No naming rights shall be sold for any structure that has been named for a person.
2 Effective Date. This act shall take effect 60 days after its passage.

HB 1400-FN-A - FISCAL NOTE
AN ACT allowing the department of transportation to sell naming rights for certain structures.
FISCAL IMPACT:
The Department of Transportation states this bill will have an indeterminable impact on state highway fund revenue and expenditures. There will be no fiscal impact on county or local revenue or expenditures.
METHODOLOGY:
The Department of Transportation states this bill authorizes the commissioner to issue requests for proposals to sell naming rights for structures such as bridges, overpasses, and exits to the highest bidder. The department is not able to estimate the market value of the naming rights or the costs associated with marketing the rights.
