STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT establishing a task force to study the charging of reimbursing employers in certain situations for the purpose of calculating unemployment benefits.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Reimbursing Employer Task Force. Amend RSA 282-A by inserting after section 12 the following new section:
282-A:12-a Reimbursing Employer Task Force.
I. There is established a task force to study the charging of unemployment benefits to employers. The members of the task force shall be as follows:
(a) One member of the senate, appointed by the president of the senate.
(b) One member of the house of representatives, appointed by the speaker of the house.
(c) The commissioner of the department of employment security, or designee.
(d) An individual representing the interests of a city or town, appointed by the governor.
(e) An attorney with experience representing workers, appointed by the governor.
(f) Four members of the business community, one of which shall represent the interests of the non-profit business community and another which shall represent the interests of the hospitality or the retail industry, appointed by the governor.
II. Legislative members of the task force shall receive mileage at the legislative rate when attending to the duties of the task force.
III. Duties. The task force shall study whether reimbursing employers should not be charged under certain circumstances, the most appropriate amount of time a tax paying employer may employ an employee without being chargeable for unemployment compensation benefits, whether the method of charging should be changed to another method such as in proportion to base period wages, and whether any other provisions in RSA 282-A should be amended to coordinate with any change from the current time period for an employer to become chargeable or any other change to the method of charging.
IV. The members of the task force shall elect a chairperson from among the members. The
first meeting of the task force shall be called by the senate member. The first meeting of the task force shall be held within 45 days of the effective date of this section. Five members of the task force shall constitute a quorum.
V. The task force shall make a final report of its findings and any recommendations for proposed legislation on or before November 1, 2012 to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library.
2 Repeal. RSA 282-A:12-a, relative to the reimbursing employer task force, is repealed.
3 Effective Date.
I. Section 2 of this act shall take effect November 2, 2012.
II. The remainder of this act shall take effect upon its passage.
