STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eighteen
AN ACT relative to the commission on primary care workforce issues.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraphs; Commission on Primary Care Workforce Issues; Membership. Amend RSA 126-T:1 by inserting after paragraph XVIII the following new paragraphs:
XIX. A nurse with experience in primary care, appointed by the New Hampshire Nurses Association.
XX. A representative of the substance use disorder treatment community, appointed by the New Hampshire Alcohol and Drug Abuse Counselors Association.
2 Commission on Primary Care Workforce Issues; Reports. Amend RSA 126-T:4 to read as follows:
126-T:4 Reports. The commission shall make an interim report on November 1, [2015] 2018 which shall focus on the status of the New Hampshire State Loan Repayment Program and the New Hampshire division of public health service's health professions survey, and a final report on November 1, [2019] 2020, including its findings and any recommendations for proposed legislation, to the speaker of the house of representatives, the president of the senate, [and] the governor, the oversight committee on health and human services, and the chairpersons of the senate and house executive departments and administration committees.
3 Commission on Primary Care Workforce Issues Extended. Amend 2010, 114:4, I as amended by 2015, 238:4 to read as follows:
I. Section 3 of this act shall take effect November 1, [2019] 2020.
4 Effective Date. This act shall take effect upon its passage.

METHODOLOGY:
This bill establishes licensing and regulation of assistant physicians by the Board of Medicine. The bill also establishes a grant program in the Department of Health and Human Services to provide matching funds for primary care clinics in medically underserved areas utilizing assistant physicians. The Department shall seek all available moneys from any source whatsoever, including but not limited to health care foundations, insurance companies, pharmaceutical companies and hospitals to assist in funding the program. A nonlapsing fund to be known as the medical clinics in medically underserved areas fund is to be administered and expended by the Commissioner of Health and Human Services. The fund shall be continually appropriated and consist of revenues from appropriations or other moneys authorized from the general fund or from Medicaid Enhancement tax receipts, or from public or private sources, including, but not limited to gifts, grants, donations, rebates, and settlements received by the state. A not-for-profit or nonprofit entity in this state that includes a medically underserved area may establish a medical clinic in such area by contributing start-up money and have such contribution matched wholly or partly by grant moneys from the medical clinics in medically underserved areas fund.
The Office of Professional Licensure and Certification states it would need to establish one new full-time Program Assistant I position (LG 15 Step1) with salary and benefits as follows: $58,000 for FY 2019, $61,000 for FY 2020, $64,000 for FY 2021 and $67,000 for FY 2022. This position would be responsible for licensing, customer service and board support. Revenue is indeterminable as the number of potential licensees is unknown.
The Department of Health and Human Services is charged with adopting administrative rules governing the matching grant program including: eligibility criteria, minimum and maximum contributions to the start-up money for a medical clinic to be matched with state grant moneys, conditions under which grant moneys shall be repaid for failure to comply with the requirements for receipt of such grant moneys, procedures for disbursement of grant moneys, the form and manner in which start-up money shall be contributed, requirements for retention of property, equipment and durable goods for 7 years, and other rules governing the program. The Department states it expects to work with the Board of Medicine to develop educational methods and programs to establish a collaborative practice service to facilitate the advancement of the assistant physician's medical knowledge and capabilities. The Department estimates it would need 1.5 full time employees to manage this program in the Office of Rural Health: 1 full time Program Specialist IV (LG 25, Step 1) to manage the program, budget and write grants, and collect on defaults; and 1 half time (0.5) Program Planner (LG 21, Step 1) to administer applications and program documentation, as well as issue and track payments. Salaries benefits, inclusive of position expenses, are listed below. The amount received and disbursed for grants is unknown.
