STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eighteen
AN ACT relative to domicile of students for voting purposes.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Voter; Domicile; Student. Amend RSA 654:1, I-a to read as follows:
I-a.(a) Student status is a neutral factor in determining domicile for voting purposes, and the mere presence of a student at the place where an institution of learning is situated is not sufficient to entitle the student to vote there. Student directories issued by a college, which include so-called permanent addresses for students are insufficient to overcome a presumption that college students who have duly registered to vote out-of-state are domiciled where they have so registered. However, a student of any institution of learning may lawfully claim domicile for voting purposes in the New Hampshire town or city in which he or she lives while attending such institution of learning if the student is an “in-state” student for tuition purposes, and such student's claim of domicile otherwise meets the requirements of RSA 654:1, I. If the student is an “out-of-state” student for tuition purposes, or if the institution is a college or university that does not discern between "out-of-state" and "in-state" students, the student shall overcome domicile requirements by presenting evidence to show whether the student came to New Hampshire solely for attending school or whether he or she intends to make this state his or her home for the time being. The burden is on the student to prove his or her domicile.
(b) “Evidence,” as used in subparagraph (a), shall include, but not be limited to, vehicle registration, driver’s license, city or county car stickers, payment of state or local taxes, participation in community and professional activities in New Hampshire, the presence of immediate family members in the state, and length of time in the state. The controlling inquiry in deciding the domicile of students for voter registration purposes is where does the student actually make his or her home and claim for the time to exercise the rights of property or of citizenship incident to or resulting from permanent domicile.
2 Effective Date. This act shall take effect 60 days after its passage.
