AN ACT relative to requirements for commercial motor vehicles.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Motor Vehicles; Words and Phrases Defined; Commercial Motor Vehicle. Amend RSA 259:12-e, I(b) to read as follows:
(b) The vehicle has a gross combination weight rating or actual weight of 26,001 or more pounds, inclusive of any towed unit with gross vehicle weight rating or actual weight of more than [10,000] 11,000 pounds;
2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill changes the definition of gross vehicle rating or actual weight of a towed unit from 10,000 lbs. to 11,000 lbs. The Department of Safety states this would affect the commercial licensing credential of the State of New Hampshire and as a result would be out of compliance with federal regulations. The Department states as a result of the non-compliance the state would realize a 5% decrease in federal funding received from the US Department of Transportation, as well as a loss of Motor Carrier Safety Assistance Program (MCSAP) funds, totaling approximately $11 million. In addition, the Department states it would incur an estimated $48,700 in one-time costs related to manual and system updates needed to implement this bill.
