The bill also provides for contributions by the withdrawing district to the cooperative district when the loss of the property results in a significant capital expense.

AN ACT relative to the disposition of property upon withdrawal from cooperative school districts.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Cooperative School Districts; Disposition of Property. Amend RSA 195:28 to read as follows:
195:28 Disposition of Property. If a pre-existing school district withdraws from the cooperative school district, the cooperative school district shall transfer and convey title to any school building and land located in the withdrawing district to the withdrawing district [upon payment by] if that building and land is primarily used by the withdrawing district, and transfer of such title will not result in a capital expenditure for the cooperative district. If it is demonstrated by the cooperative school district that the land and building in the withdrawing district is necessary for the education of students in the cooperative district and loss of the land and building would require significant capital expense, then the withdrawing district [of] shall contribute the costs of capital improvements and additions to said school building incurred by the cooperative school district, less the share which the withdrawing school district has already paid toward such costs and the share which the withdrawing school district is required to contribute toward such costs as provided in RSA 195:27, before conveyance of title of the land and building to the withdrawing district. The amount of said capital improvements and additions and the time of transfer of title shall be determined by the agreement for withdrawal between the cooperative school district and the withdrawing school district. The withdrawing school district forfeits its equity in all other cooperative school district facilities.
2 Effective Date. This act shall take effect 60 days after its passage.
