STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eleven
AN ACT relative to late fees charged by utilities.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Public Utility Charges. Amend RSA 374:2 to read as follows:
374:2 Charges; Violations.
I. All charges made or demanded by any public utility for any service rendered by it or to be rendered in connection therewith, shall be just and reasonable and not more than is allowed by law or by order of the public utilities commission. Every charge that is unjust or unreasonable, or in excess of that allowed by law or by order of the commission, is prohibited.
II. Any public utility may charge a late fee of not more than ½ of one percent of any customer’s balance still unpaid more than 30 days after the date of the mailing of the bill.
III. Any public utility that violates paragraph II shall be subject to an administrative fine to be determined by the public utilities commission of up to $100 per offense.
2 Effective Date. This act shall take effect 60 days after its passage.
