AN ACT prohibiting an employer from requiring an employee or prospective employee to disclose his or her social media passwords.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Thirteen
AN ACT prohibiting an employer from requiring an employee or prospective employee to disclose his or her social media passwords.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subdivision; Use of Social Media. Amend RSA 275 by inserting after section 70 the following new subdivision:
275:71 Definition. In this subdivision, “social media” means an electronic medium where users may create and view user-generated content, including uploading or downloading videos or still photographs, blogs, video blogs, podcasts, or instant messages.
275:72 Employer Use of Social Media. No employer shall require an employee or prospective employee to disclose a user name or account password to access social media used by the employee or prospective employee.
2 Effective Date. This act shall take effect 60 days after its passage.
