HOUSE BILL 38
AN ACT relative to emergency use of public docks and piers.
COMMITTEE: Municipal and County Government
This bill limits the enforcement of posted hours for public docks and piers during medical emergencies and inclement weather.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eleven
AN ACT relative to emergency use of public docks and piers.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Emergency Use of Public Docks and Piers. Amend RSA 270-D by inserting after section 5 the following new section:
270-D:5-a Emergency Use of Public Docks and Piers.
I. No peace officer or agent of a public entity shall order a boat off a public dock or pier because it is after posted hours if the boat is docked due to a medical emergency.
II. No peace officer or agent of a public entity shall order a boat off a public dock or pier because it is after posted hours during inclement weather, provided that:
(a) The operator remains with the boat;
(b) The operator maintains a watch while waiting for a break in the inclement weather; and
(c) The boat embarks immediately following the period of inclement weather.
2 Effective Date. This act shall take effect 60 days after its passage.
