STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Five
AN ACT relative to adding retired fire apparatus (fire trucks) to antique vehicle exemptions.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Antique Motor Vehicle, Farm Tractor, Retired Fire Apparatus, or Motorcycle. Amend RSA 259:4 to read as follows:
259:4 Antique Motor Vehicle, Farm Tractor, Retired Fire Apparatus, or Motorcycle. "Antique motor vehicle, farm tractor, retired fire apparatus, or motorcycle" shall mean any motor vehicle, including a truck regardless of its weight, over 25 years old, and in the case of a retired fire apparatus, over 20 years old, which is maintained for use in exhibitions, club activities, parades, and other functions of public interest, but not for use in commerce. For the purposes of this section, "maintained for use" shall mean a motor vehicle, retired fire apparatus, or motorcycle in its original condition or restored to original or better condition and not intended for daily use.
2 Equipment Prohibited; Sirens. Amend RSA 266:73 to read as follows:
266:73 Sirens. It shall be unlawful for any motor vehicle to be driven on the ways of this state equipped with a siren. The provisions of this section shall not apply to such emergency vehicles as police, fire department, fire patrol, state department of corrections vehicles, retired fire apparatuses as defined under RSA 259:4, nor to those law enforcement officers or volunteer members of fire departments nor to public or private ambulances.
3 Emergency Lights and Warning Lights; Red Lights Restricted to Police, Fire, and Rescue Vehicles. Amend RSA 266:78-c, I to read as follows:
I. Emergency response vehicles owned or leased by municipal, village district, or federal fire departments and forestry departments, and retired fire apparatuses.
4 Lights, Signals, Flashers, Reflectors and Flags; Antique Vehicles Exemption. Amend RSA 266:33 to read as follows:
266:33 Antique Vehicles Exemption. Notwithstanding the provisions of RSA 266:44, the tail lamps on antique motor vehicles, farm tractors, retired fire apparatuses, or motorcycles as defined in RSA 259:4 shall be deemed adequate if they display a red light visible for a distance of 100 feet to the rear of such vehicle, and the tail lamp or lamps on such vehicles may be located at a height of more than 72 inches from the ground, provided they were so located at the time of original manufacture of the vehicle.
5 Effective Date. This act shall take effect 60 days after its passage.
