STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Seventeen
AN ACT relative to the practices of pharmacy benefit managers.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subparagraph; Managed Care Law; Provider Contracts; Pharmacy Benefit Managers. Amend RSA 420-J:8, XV by inserting after subparagraph (b) the following new subparagraph:
(c) A pharmacy benefit manager shall not require accreditation, credentialing, or licensing of providers other than by the New Hampshire pharmacy board or other state or federal entity.
2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill limits accreditation and licensing requirements that a pharmacy benefit manager can use. The Insurance Department states this bill may require pharmacy benefit managers to credential more providers than they would otherwise which could impact their ability to negotiate prices. This could ultimately impact health insurance premium rates paid by counties and municipalities. This bill will not impact state expenditures as the State provides health insurance to its employees through a self-funded plan. Finally, changes to health insurance premiums could impact state unrestricted revenue collected through the insurance premium tax.
The Office of Professional Licensure and Certification states this bill will have no impact on its budget.
