This bill prohibits the department of environmental services from requiring a repeat examination administered by the International Code Council or NACE International for the renewal of underground storage tank and above ground storage tank certifications.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Thirteen
AN ACT relative to underground storage tank and above ground storage tank certification.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Rulemaking; Underground Storage Facilities. Amend RSA 146-C:9 by inserting after paragraph XIII the following new paragraph:
XIV. Procedures, forms, and criteria for issuing certifications for conducting underground storage tank installation, operation, maintenance, testing, and removal.
2 New Section; Underground Storage Facilities; Certifications. Amend RSA 146-C by inserting after section 9-a the following new section:
146-C:9-b Certifications. In order to install an underground storage tank (UST), perform cathodic testing on a UST, test a UST, or remove a UST, a person shall hold the appropriate UST certificate from the International Code Council or NACE International. In order to renew certification, the certificate holder shall fulfill any educational requirements deemed necessary by the commissioner. Such educational requirements shall be offered by the department or the commissioner may, in his or her discretion, identify equivalent training to meet such requirements. An examination by the International Code Council or NACE International shall not be required to complete a renewal of a UST certificate.
3 New Paragraph; Rulemaking; Above Ground Storage Facilities. Amend RSA 146-A:11-c by inserting after paragraph XIV the following new paragraph:
XV. Procedures, forms, and criteria for issuing and renewing certificates pertaining to the installation, operation, maintenance, and removal of above ground storage tanks.
4 New Section; Above Ground Storage Facilities; Certification. Amend RSA 146-A by inserting after section 11-c the following new section:
146-A:11-d Certification. In order to inspect, install, or remove an above ground storage tank (AST), a person shall hold an AST certificate from the International Code Council or NACE International. In order to renew certification, the certificate holder shall fulfill any educational requirements deemed necessary by the commissioner or the commissioner may, in his or her discretion, identify equivalent training to meet such requirements. Such educational requirements shall be offered by the department. An examination by the International Code Council or NACE International shall not be required to complete a renewal of an AST certificate.
5 Effective Date. This act shall take effect 60 days after its passage.

HB 628 FISCAL NOTE
AN ACT relative to underground storage tank and above ground storage tank certification.
FISCAL IMPACT:
The Department of Environmental Services states this bill, as introduced, will increase state general fund expenditures by $179,181 in FY 2014, $183,627 in FY 2105, $192,047 in FY 2016 and $193,524 in FY 2017. There is no fiscal impact on county and local expenditures, or state, county, and local revenue.
METHODOLOGY:
The Department of Environmental Services states this bill requires a person hold the appropriate underground storage tank certificate or above ground storage tank certificate from the International Code Council or NACE International to install, perform tests or remove underground storage tanks or above ground storage tanks. The bill further states the Department offer the required educational requirements or identify equivalent training to meet the requirements for renewal. The Department states it would need to hire two additional staff (one civil engineer IV and one program assistant I) to develop, implement, and manage the educational program for the renewal of underground storage tank or above ground storage tank certifications. The Department states it would also need to hire a consultant to provide the classroom training. Below are the estimated costs associated with the positions
