AN ACT requiring a person to have a domicile in the district from which they serve as county commissioner.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

AN ACT requiring a person to have a domicile in the district from which they serve as county commissioner.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  County Commissioner Domicile Requirement.  Amend RSA 655:9 to read as follows:

655:9 County Officers.  To hold the office of county commissioner, sheriff, county attorney, county treasurer, register of deeds, or register of probate, a person must have a domicile in the county for which he is chosen. In addition, to hold the office of county commissioner in the counties of Rockingham, Belknap, Grafton, Merrimack, Hillsborough, Cheshire, Sullivan, Coos, [and] Carroll, and Strafford, a person must have a domicile in the district from which he is elected at the time of his election.

2  Application; Strafford County.  The changes in domicile requirements for service as a Strafford county commissioner established by this act shall not affect constituencies or terms of office of commissioners presently in office. The commissioner domicile requirements established by this act shall be in effect for the purpose of electing commissioners at the 2026 state general election. If there shall be a vacancy in a commissioner district for any reason prior to the 2026 state general election, the vacancy shall be filled as provided in law for Strafford county commissioners that existed for the 2024 state general election.

2  Effective Date.  This act shall take effect upon its passage.
