STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

AN ACT relative to registration of vehicles in a fleet of 25 or more.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Five-Year Fleet Registration Program.  Amend RSA 261 by inserting after section 140-d the following new section:

140-e  Five-Year Fleet Registration Program.

I.  The division of motor vehicles shall establish a 5-year registration program whereby qualified registrants, according to paragraph II, may elect a common quinquennial expiration date for all vehicles in the same fleet.  Motor vehicles registered pursuant to the 5-year fleet registration program shall be issued registration credentials for a period of 5 years.  A registrant may transfer a registration of a permanently retired fleet vehicle to a new in-service fleet vehicle for the remaining period of registration.

II.  The 5-year fleet registration program shall be solely for the registration of a fleet of 25 or more in-service vehicles.  Prior to fleet registration, a prospective registrant shall submit a current New Hampshire certificate of good standing issued by the secretary of state's office to the division of motor vehicles and receive the division's approval to enroll in the program.  Once enrolled in the program, a registrant shall annually submit a current certificate of good standing as directed by the division.  Additionally, the division may require a registrant to produce a current certificate of good standing at any time during the 5-year period of registration.  If a registrant is not in good standing with the secretary of state or fails to meet other enrollment criteria set by the division of motor vehicles, including failing to maintain an in-service fleet of 25 or more vehicles, the division shall terminate the registrant's fleet registration and revert any existing registration credentials to those of a non-fleet vehicle.

III.  Upon application, and then annually at a time prescribed by the division, the prospective registrant shall provide an itemized account of all motor vehicles in the fleet in the manner required by the division.  The division shall calculate and collect both the state and municipal portions of fees for the entire 5 year period, based on rate and fee calculations under RSA 261:141, RSA 261:74-d, RSA 261:153, and RSA 154, if applicable.  If the fleet registration is governed by the International Registration Plan (IRP), the costs and fees shall be determined according to the IRP.  A municipality shall report any mill rate and fee updates to the division of motor vehicles annually on May 1.  The division of motor vehicles shall disburse the municipal portions of the fees and costs collected upon registration to the appropriate municipality within 30 days of receipt.  Any vehicle added to the fleet after the initial fleet registration and that is not to be registered under a transfer shall have its registration prorated from date of registration transfer until the common expiration date, and shall have as its base municipality the municipality in which the vehicle is parked overnight 50 percent or more of the time.  No registrant shall be eligible for a refund of any kind for registrations under this section.

IV.  Off highway recreational vehicles as defined in RSA 215-A:1 and snowmobiles as defined in RSA 259:102 shall not be not eligible for fleet vehicle registration.

V.  The director of the division of motor vehicles shall adopt rules pursuant to RSA 541-A regarding enrollment and cancellation of enrollment in the program, filing, invoicing, and payment procedures under the program, and any other matters required for program administration under this section.

2  Effective Date.  This act shall take effect January 1, 2026.

FISCAL IMPACT:

The Office of Legislative Budget Assistant is unable to complete a fiscal note for this bill as it is awaiting information from the Department of Safety.  The Department was contacted on 1/15/25 for a fiscal note worksheet.  When completed, the fiscal note will be forwarded to the Senate Clerk's Office.
