AN ACT relative to the therapeutic cannabis program.

ANALYSIS

 

This bill amends the definition of "provider" for purposes of the therapeutic cannabis program to require a physician assistant to prescribe consistent with a collaboration agreement if such an agreement is required; clarifies that provider concerns that are required to be sent to the applicable regulatory authority includes New Hampshire regulatory authorities; and adds that prohibitions applicable to providers also applies to analogous interactions with out-of-state entities.

This bill is a request of the department of health and human services.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

AN ACT relative to the therapeutic cannabis program.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Use of Cannabis for Therapeutic Purposes; Definitions.  Amend RSA 126-X:1, VII(a)(4) to read as follows:

(4) A physician assistant licensed pursuant to RSA 328-D and who possesses an active registration from the United States Drug Enforcement Administration to prescribe controlled substances consistent with his or her collaboration agreement if one is required under RSA 328-D:3-b; or

2  Use of Cannabis for Therapeutic Purposes; Departmental Administration; Registry Identification Cards.  Amend RSA 126-X:4, VII(c) to read as follows:

(c) Any concerns regarding provider conduct shall be referred to the New Hampshire board of medicine, the New Hampshire board of nursing, or the appropriate regulatory entity in New Hampshire, Maine, Massachusetts, or Vermont. The New Hampshire board of medicine, the New Hampshire board of nursing, or the appropriate regulatory entity in New Hampshire, Maine, Massachusetts, or Vermont may direct the department to prohibit a provider's participation in New Hampshire's therapeutic cannabis program if the regulatory entity takes disciplinary action against a provider regarding the provider's involvement in the therapeutic cannabis program in New Hampshire or in his or her respective state.

3  Use of Cannabis for Therapeutic Purposes; Alternative Treatment Centers; Requirements.  Amend RSA 126-X:8, XVIII to read as follows:

XVIII.(a)  A provider shall not:

[(a)](1)  Accept, solicit, or offer any form of pecuniary remuneration from or to an alternative treatment center, except if the provider is employed by an alternative treatment center.

[(b)](2)  Offer a discount or other thing of value to a patient who uses or agrees to use a particular alternative treatment center.

[(c)(3)  Examine a patient in relation to issuing a written certification at a location where cannabis is sold or distributed.

[(d)](4)  Hold an economic interest in an alternative treatment center if the provider issues written certifications to patients.

(b) The prohibitions in subparagraph (a)(1)-(4) shall also be applicable with regard to cannabis dispensaries and other cannabis entities in other states.

4  Effective Date.  This act shall take effect 60 days after its passage.
