AN ACT establishing a commission to study how the Patient Protection and Affordable Care Act of 2009, as amended, will affect emergency and ambulance providers.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT establishing a commission to study how the Patient Protection and Affordable Care Act of 2009, as amended, will affect emergency and ambulance providers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Chapter; Commission to Study the Effect of the Federal Heath Care Law on Emergency and Ambulance Providers. Amend RSA by inserting after chapter 126-U the following new chapter:

CHAPTER 126-V

COMMISSION TO STUDY THE EFFECT OF THE FEDERAL HEATH CARE LAW

ON EMERGENCY AND AMBULANCE PROVIDERS

126-V:1 Commission Established.

I.(a) There is established a commission to study the effect of the Patient Protection and Affordable Care Act of 2009, as amended, on emergency and ambulance providers. The members of the commission shall be as follows:

(1) One member of the senate, appointed by the president of the senate.

(2) One member of the house of representatives, appointed by the speaker of the house of representatives.

(3) The insurance commissioner, or designee.

(4) Two public members who have experience in the emergency medical services industry, appointed by the governor and council.

(b) Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

II. The commission shall study how the Patient Protection and Affordable Care Act of 2009, as amended, will affect the cost of delivering emergency medical services in New Hampshire communities.

III. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the senate member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Three members of the commission shall constitute a quorum.

IV. The commission shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2013.

2 Repeal. RSA 126-V, relative to a commission to study the effect of the Patient Protection and Affordable Care Act of 2009, as amended, on emergency and ambulance providers, is repealed.

3 Effective Date.

I. Section 2 of this act shall take effect November 1, 2013.

II. The remainder of this act shall take effect upon its passage.
