STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eighteen
AN ACT relative to certain court orders in a divorce/custody matter.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Parental Rights and Responsibilities; Decision Making Responsibility Regarding Vaccinations. Amend RSA 461-A by inserting after section 19 the following new section:
461-A:19-a Childhood Vaccinations. If there has been no disagreement between a child's parents for more than 6 years regarding the decision not to vaccinate the child, neither parent shall seek an order to have the child vaccinated, or otherwise request a modification of the parenting plan or decision making responsibility regarding vaccinations, in any proceeding under this chapter. In such cases, if the child is exempt from immunization pursuant to RSA 141-C:20-c, the court shall have no authority to order the child to be vaccinated.
2 Effective Date. This act shall take effect January 1, 2019.
