An Act concerning Medicaid reimbursement for certain residential facilities and programs and supplementing Title 26 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. As used in this act:
"Provider of assisted living services" means a facility or agency that is licensed to operate an assisted living residence, comprehensive personal care home or assisted living program and participates in a federally approved waiver program under section 1915(c) of the federal Social Security Act (42 U.S.C. s.1396n(c)).
"Medicaid" means the program established pursuant to P.L.1968, c.413 (C.30:4D-1 et seq.).
"Medicaid-eligible" means that a person is determined to meet Medicaid financial eligibility standards and is approved by the Department of Health and Senior Services for participation in a federally approved waiver program under section 1915(c) of the federal Social Security Act (42 U.S.C. s.1396n(c)) that provides assisted living services.
2. a. In fiscal year 2002, the Medicaid program shall reimburse providers of assisted living services at the following per diem rates to meet the health care needs of their Medicaid-eligible residents: $70 for providers of assisted living residences, $60 for providers of comprehensive personal care homes, and $50 for providers of assisted living programs.
b. In fiscal year 2003 and each fiscal year thereafter, the Commissioner of Health and Senior Services shall increase the reimbursement rates established pursuant to subsection a. of this section, in order to account for inflation, by a combined percentage amount that is equal to: 40% of any percentage increase in the Consumer Price Index published by the United States Department of Labor, Bureau of Labor Statistics, now known as the "Consumer Price Index for Urban Wage Earners and Clerical Workers, All Items, New York-Northern New Jersey (index: 1982-1984 equals 100)"; plus 60% of any percentage increase in average wage rates for health care workers in long-term care facilities in New Jersey as determined by the Commissioner of Health and Senior Services, in consultation with the Commissioner of Labor, based upon wage rates for appropriate health occupations as surveyed by the Department of Labor or derived from wage data compiled by the United States Department of Labor, Bureau of Labor Statistics.
3. The Commissioner of Health and Senior Services shall adopt regulations pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.) necessary to carry out the purposes of this act.
4. This act shall take effect July 1, 2001, and if enacted after that date shall be retroactive thereto.
STATEMENT
This bill requires that in fiscal year (FY) 2002, the Medicaid program shall reimburse providers of assisted living services at the following per diem rates to meet the health care needs of their Medicaid-eligible residents: $70 for providers of assisted living residences, $60 for providers of comprehensive personal care homes, and $50 for providers of assisted living programs.
