An Act concerning bail and supplementing Title 2A of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. In determining the appropriate amount and conditions of bail, the court shall, in addition to any other factors, consider whether a defendant is a member of a criminal street gang, as defined in section 1 of P.L.2007, c.341 (C.2C:33-29).
2. This act shall take effect immediately.
STATEMENT
This bill supplements N.J.S.A.2C:6-1 to require the court to consider whether the defendant is a member of a criminal street gang when making bail determinations.
