     Requires basic generation service providers and electric public utilities to provide electric service at reduced rates to green buildings.

An Act providing for reduced rates for electric service to buildings, and supplementing P.L.1999, c.23 (C.48:3-49 et al.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  For the purposes of this section, "green building" means a building constructed with an integrated focus on energy efficiency and performance, energy and water conservation, indoor environmental quality, and other elements of sustainable design, construction, and operation.  "Green building" includes buildings certified, and projects designed and constructed in a manner to achieve certification, by the Leadership in Energy and Environmental Design (LEED) Green Building Rating System, as adopted by the United States Green Building Council, and buildings qualified as Energy Star compliant by the United States Environmental Protection Agency and United States Department of Energy.

     b.    The provisions of P.L.1999, c.23 (C.48:3-49 et al.) and any other law, rule, order or regulation to the contrary notwithstanding, a basic generation service provider and an electric public utility, respectively, shall provide basic generation service or electric transmission and distribution service to a green building at a discount from the pertinent established rates for that service.  Such discounted rates shall be established by the board. 

 

     2.    With respect to basic generation service, the discounting of rates under section 1 of P.L.    , c.   (C.      )(pending before the Legislature as this bill) to ratepayers covered by a contract for the supply of such service that is in effect on the effective date of this act shall be implemented upon the renewal or expiration of that contract.

 

     3.    This act shall take effect on the first day of the third month following enactment, except that the board may take such action in advance of the effective date as shall be necessary to implement the provisions of this act.

 

 

STATEMENT

 

     This bill would require basic generation service providers and electric public utilities, respectively, to provide basic generation service and electric transmission and distribution service to a green building at a discount from the pertinent established rates for that service.  Such discounted rates shall be established by the Board of Public Utilities.
