SYNOPSIS

     Prohibits double-trailer truck combinations on certain portions of U.S. Route 206 in Mercer and Somerset counties.

An Act prohibiting certain commercial motor vehicles on portions of U.S. Route 206 and supplementing Title 39 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    As used in this act:

     "Double-trailer truck combination" means a truck-tractor semitrailer-semitrailer combination, and which meets the equipment length requirement as set forth in R.S.39:3-84 and 23 CFR 658.13.

 

     2.    Notwithstanding any law, rule, or regulation to the contrary, a double-trailer truck combination is prohibited from using that portion of U.S. Route 206 from its intersection with Princeton Pike in Mercer County to its intersection with Somerset Street in Somerset County.

     Nothing in this section shall apply to emergency vehicles, or government-owned or government-leased vehicles.

 

     3.    The driver, owner, lessee, or bailee of any double-trailer truck combination found or operated in violation of the provisions of this act shall be subject to a fine of $500 for the first offense, $1,000 for the second offense, and $2,000 for each subsequent offense.

 

     4.    The Commissioner of Transportation shall adopt, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), any rules and regulations necessary to effectuate the purposes of this act.  Any rules and regulations authorized to be promulgated under the provisions of this act shall be consistent with the rules and regulations promulgated by the United States Secretary of Transportation and the federal "Surface Transportation Assistance Act of 1982."

 

     5.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill prohibits a double-trailer truck combination from using that portion of U.S. Route 206 from its intersection with Princeton Pike in Mercer County to its intersection with Somerset Street in Somerset County.

     This bill also provides that the driver, owner, lessee, or bailee of any double-trailer truck combination found or operated in violation of the provisions of this act shall be subject to a fine of $500 for the first offense, $1,000 for the second offense, and $2,000 for each subsequent offense.
