An Act requiring the New Jersey Transit Corporation to provide certain ticket refunds and supplementing P.L.1979, c.150 (C.27:25-1 et seq.).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. Upon request, the corporation, or any public or private entity under contract to the corporation to provide motorbus regular route or rail passenger service, shall provide an individual who has purchased a ticket for the use of such service with a full refund in the amount of the original purchase price of the ticket in the event that the ticket is not used.
b. An individual shall request a refund for any unused ticket within 30 days of the date on which the ticket was purchased.
c. The corporation may require an individual requesting a refund for an unused ticket to provide the corporation with proof of payment of such unused ticket.
2. The provisions of this act shall not apply to multi-ride tickets, to weekly or monthly passes, or to use of light rail vehicles under certain conditions. In the case of a multi-ride ticket, the amount of the refund shall be the amount of the original purchase price of the unused portion of the ticket. In the case of a weekly or monthly pass, the amount refunded will be on a pro rata basis. In the case of a ticket which has been purchased for passage on a light rail system but not validated, the amount of the refund shall be the amount of the original purchase price of the ticket. In the case of such a ticket which has been purchased and validated, no refund shall be required.
3. The corporation shall promulgate rules and regulations necessary to effectuate the purposes of this act.
4. This act shall take effect on the 60th day after enactment, but the corporation may take such anticipatory administrative action in advance as shall be necessary for the implementation of the act.
STATEMENT
This bill requires NJ Transit and its contract carriers to provide an individual, upon request, with a full refund for any unused ticket purchased for the use of motorbus regular route or rail passenger service. The individual requesting a refund for an unused ticket shall make such request within 30 days of the date of purchase. NJ Transit may require an individual requesting a refund for an unused ticket to provide proof of payment.
In the case of multi-ride tickets, NJ Transit shall be required to provide a refund for the unused portion of the ticket only. In the case of weekly or monthly passes, NJ Transit shall provide refunds on a pro rata basis. In the case of tickets purchased for the use of a light rail system, a refund shall only be required if the ticket has not been validated.
