     Requires State to pay expenses associated with nonpartisan municipal elections.

An Act concerning expenses associated with the holding of nonpartisan municipal elections and amending R.S.19:45-5.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    R.S.19:45-5 is amended to read as follows:

     19:45-5.      a.  All costs, charges and expenses incurred by the municipal clerk or any other  officer or official of a municipality in carrying out the provisions of this title shall be paid by such municipality except as herein otherwise provided.

     b.    Where any election is held in and for a municipality only, all costs, charges and expenses, including the compensation of the members of the district  boards of the municipality and the compensation and expenses of the county board and the clerk thereof, for such elections, shall be paid by the municipality.

     c.    Notwithstanding the provisions of subsections a. and b. of this section, all costs, charges and expenses incurred by a municipality for the holding of an election pursuant to P.L.1981, c.379 (C.40:45-5 et seq.) shall be paid for by the State in a timely manner following the election after the municipality has filed an application for reimbursement with the Secretary of State and it has been approved by the Director of the Division of Budget and Accounting in the Department of the Treasury.

     2.    This act shall take effect immediately and be applicable to elections held after January 1 next following the date of enactment.

 

 

STATEMENT

 

     The purpose of this bill is to require the State to pay all of the expenses that a municipality incurs when it holds a nonpartisan municipal election.  The expenses would be paid for by the State in a timely manner following the election after the municipality has filed an application for reimbursement with the Secretary of State and it has been approved by the Director of the Division of Budget and Accounting in the Department of the Treasury.

     Such expenses typically include the cost of publishing the names of the candidates in two newspapers in circulation in the municipality and published in this State, and of printing the many different types of ballots used in connection with an election.  The expenses would not include the compensation paid to poll workers, because under current law the State now pays $125 of the $200 that each poll worker receives from a county board of elections for serving on the day of such an election.
