SYNOPSIS
Requires assisted living residences to have standby emergency power generators.

An Act concerning facilities licensed to operate assisted living residences and supplementing Title 26 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. (1) A facility licensed to operate an assisted living residence pursuant to P.L.1971 c.136 (C.26:2H-1 et seq.), on or after the effective date of this act, shall be equipped with and employ a standby emergency power generator in the event of a power outage at the facility.
(2) A facility licensed to operate an assisted living residence prior to the effective date of this act shall be equipped with and employ, within 90 days of the effective of this act, a standby emergency power generator in the event of a power outage at the facility.
b. A facility licensed to operate an assisted living residence shall ensure that a standby emergency power generator is checked, tested, and serviced in accordance with generally accepted engineering practices.
2. Pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), the Commissioner of Health and Senior Services shall adopt rules and regulations necessary for the implementation of this act.
3. This act shall take effect immediately.
STATEMENT
This bill concerns standby emergency power generators for assisted living residences and requires a facility licensed to operate an assisted living residence, on or after the effective date of this bill, to be equipped with and employ a standby emergency power generator in the event of a power outage at the facility.
For an existing facility licensed to operate an assisted living residence, the bill requires the facility to be equipped with and employ a standby emergency power generator within 90 days of the bill's effective date.
The bill also provides that the facility must ensure that a standby emergency power generator is checked, tested, and serviced in accordance with generally accepted engineering practices.
Lastly, the bill requires the Commissioner of Health and Senior Services to adopt rules and regulations necessary for the bill's implementation.
