     Prohibits annual bonuses for perfect attendance and the non-use of sick leave.

An Act concerning additional compensation awarded to employees of certain political subdivisions and amending N.J.S.11A:6-23 and N.J.S.40A:9-10.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    N.J.S.11A:6-23 is amended to read as follows:

     11A:6-23.  [Supplemental compensation; rules.]  a.  The Civil Service Commission shall adopt rules for the implementation of supplemental compensation, which shall include but need not be limited to application and eligibility procedures.

     b.    Except as otherwise provided by law, a political subdivision of the State that is not a school district, or an agency, authority, or instrumentality of a subdivision that has adopted the provisions of Title 11A, Civil Service, of the New Jersey Statutes shall not grant to its employees any additional paid personal leave, bonus payment, or other monetary remuneration for either perfect attendance or the non-use of sick leave.

     2.    N.J.S.40A:9-10 is amended to read as follows:

     40A:9-10. a.  Except as otherwise provided by law, the board of chosen freeholders of the county or the governing body of the municipality shall fix the amount of salary, wages or other compensation to be paid to county and municipal officers and employees unless they are to serve without compensation.

     b.    Except as otherwise provided by law, a political subdivision of the State that is not school district, or an agency, authority, or instrumentality of a subdivision that has not adopted the provisions of Title 11A, Civil Service, of the New Jersey Statutes shall not grant to its employees any additional paid personal leave, bonus payment, or other monetary remuneration, for either perfect attendance or the non-use of sick leave.

     3.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would prohibit certain political subdivisions, including counties, municipalities, fire districts, and special districts, from rewarding their employees for perfect attendance and the non-use of sick leave.  This legislation is intended to address abuses discussed by the State Commission of Investigation (SCI) in its December 2009 report entitled "The Beat Goes On...Waste and Abuse in Local Government Employee Compensation and Benefits."  According to the SCI, several municipalities, including East Windsor, Hoboken, Rutherford, and Union City, provide their employees with supplemental compensation for perfect attendance or the non-use of sick leave.  It is the sponsor's belief that public employees should show up for work without the benefit of special incentives.

     This legislation would not affect current laws that allow counties and municipalities to establish and maintain award programs designed to promote efficiency and economy in government functions or to reward individual employees for meritorious performances and suggestions.
