     Establishes additional ethical requirements concerning sale or conveyance of property or development rights to the State or other public entities by elected public official or immediate family member thereof.

An Act concerning the sale or conveyance of property or development rights by certain persons and supplementing Title 40A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  An elected public official, or immediate family member thereof, or a business organization in which the official or immediate family member has an interest, wishing to sell or convey property or development rights, owned by that official, an immediate family member thereof, or business organization in which the official or an immediate family member has an interest, to the State or any other public entity, shall, in the initial application or proposal for consideration of the sale or conveyance and in addition to any other disclosure or reporting requirements established by law:

     (1)   identify the elected public official's or immediate family member's title, or the interest the elected public official or immediate family member has in the involved business, the names of immediate family members, the names of immediate family member's immediate family members, any business organization in which the official or an immediate family member has an interest, the public officials with whom the elected public official or the immediate family members thereof has contact as part of business, personal interactions, or regular official or campaign business, and persons, entities, or organizations from whom the elected public official or immediate family member thereof has received any financial benefit;

     (2)   provide the initial purchase price of, any valuation assessments available concerning, the property or development rights for sale or conveyance, and the number of comparables usually required for a standard revaluation of property in the applicable area of the State; and

     (3)   provide, in the case of property or development rights being sold or conveyed for the purposes of farmland preservation, information or assessments concerning the property's value as farmland and any information or assessments which may be relevant to prioritizing the property over other comparable properties or explaining the unique features of the property that exclude or limit the comparables for this property and the intended purpose.

     b.    The elected public official who is selling or conveying the property or development rights, any immediate family member thereof, member or employee of any business organization in which the elected public official or an immediate family member thereof has an interest, and any other public official who has received financial benefit of any kind from the property owner, immediate family member thereof, the property owner's business or any business organization in which the property owner or an immediate family member thereof has an interest, or shall receive any financial benefit from the sale or conveyance under consideration, shall recuse themselves from any vote, discussion or negotiation concerning the sale or the conveyance and the decision to offer to purchase, or accept the conveyance of,  the property or development rights in question.

     c.     For the purposes of this section, "immediate family member" means and includes a person's spouse and children, the person's siblings and parents, the person's spouse's siblings and parents, and the spouses of the person.

 

     2.  a.  All documentation and information required for consideration of the sale, including, but not limited to, the documentation and information required pursuant to section 1 of this act shall be submitted to the Attorney General or other appropriate third party who would not receive any type of gain from the approval of the sale, as determined and designated by the Attorney General.  The Attorney General or other designated third party shall review all documentation and information and issue a determination concerning the eligibility of the elected public official, an immediate family member thereof, or business organization in which the official or an immediate family member has an interest, selling or conveying the property or development rights, to proceed with the offering.

     b.    No purchase or conveyance of property or development rights may be made or approved by the State or other public entity until 90 days after the determination pursuant to subsection a. of this section has been made.

 

     3.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill establishes additional ethical requirements to those already established by law concerning sale or conveyance of property or development rights to the State or other public entities by an elected public official, an immediate family member thereof, or a business organization in which the official or an immediate family member has an interest.
