     Requires State provide description of services to be provided if local unit must pay for services.

An Act concerning local mandates and supplementing chapter 13H of Title 52 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  a.  In the event a service is provided to a board of education, county, municipality, or fire district by the State or any of its agencies for which the State mandates payment, in full or in part, by the local unit, prior to delivering the service, the State, shall furnish each participating local unit with a description of the service specifying the anticipated frequency and intensity with which the service will be provided.  The amount of the payment required by the State from the school board, county, municipality, or fire district shall not exceed an amount that is reasonably related to the actual cost to the State to provide the service.

     b.  Whenever the State mandates the creation of a local service that is to be funded by the State the details of the local service shall be specified in order to ensure that the amount of State funds provided is reasonably related to the actual cost to provide the local service.

 

     2.  This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires that in the event the State requires a school board, county, municipality, or fire district to pay for a service provided by the State, or requires the local unit create a new local service, then the State must provide the local unit with a description of the service stating the frequency and intensity with which the service will be provided.  The bill further requires that the amount of payment demanded by the State in consideration for the service provided be reasonably related to the actual cost of the service.
