     Eliminates COAH requirement that municipality obtain initial plan endorsement from the State Planning Commission to retain substantive certification.

An Act concerning the granting of substantive certification to municipal housing plans and supplementing the "Fair Housing Act," P.L.1985, c.222 (C.52:27D-301 et al.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  Notwithstanding the provisions of any law, rule or regulation to the contrary, a municipality that has received a grant of substantive certification shall not be required to obtain initial plan endorsement from the State Planning Commission in order to retain the grant of substantive certification.

 

     2.  This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would eliminate the current requirement, as set forth in regulations issued by the Council on Affordable Housing, that a municipality must obtain an initial plan endorsement from the State Planning Commission by the three year anniversary review by the council pursuant to the "Fair Housing Act," P.L.1985, c.222 (C.52:27D-301 et al.).
