An Act requiring retinal scanning of Medicaid applicants and supplementing P.L.1968, c.413 (C.30:4D-1 et seq.).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. The Commissioner of Human Services shall implement the use of retinal scans for persons who apply to the Medicaid program established pursuant to P.L.1968, c.413 (C.30:4D-1 et seq.), to the greatest extent practicable and as permitted by federal law, and shall incorporate this data into the Medicaid recipient database that is maintained by the program and utilize this information for the purposes of the program.
b. The commissioner shall ensure that the data obtained pursuant to subsection a. of this section is maintained in a confidential manner and is utilized solely for the purposes of the Medicaid program.
2. The commissioner shall report to the Governor, and to the Legislature pursuant to section 2 of P.L.1991, c.164 (C.52:14-19.1), no later than one year after the effective date of this act, on the implementation of retinal scanning pursuant to section 1 of this act, and shall include, at a minimum, in that report:
a. a detailed explanation of how the retinal scanning process was implemented;
b. the number of Medicaid applicants who have undergone a retinal scan for the purposes of this act;
c. the costs, both incurred to date and projected, of implementing the scanning requirement;
d. an explanation of why any category of Medicaid applicants was excluded from the scanning requirement;
e. a detailed explanation of any significant technical, logistical, or administrative difficulties encountered in the implementation of retinal scanning;
f. a detailed explanation of how the data obtained from retinal scanning is being maintained and utilized; and
g. any recommendations that the commissioner desires to make concerning the use of retinal scanning for the purposes of the Medicaid program.
3. This act shall take effect on the first day of the seventh month following the date of enactment, but the Commissioner of Human Services may take such anticipatory administrative action in advance thereof as shall be necessary for the implementation of this act.
STATEMENT
This bill requires the Commissioner of Human Services to utilize retinal scanning for Medicaid applicants in accordance with its provisions.
The bill provides specifically as follows:
· The commissioner is directed to implement the use of retinal scans for persons who apply to the Medicaid program, to the greatest extent practicable and as permitted by federal law, and to incorporate this data into the Medicaid recipient database that is maintained by the program and utilize this information for the purposes of the program.
· The commissioner is to ensure that the data obtained pursuant to this bill is maintained in a confidential manner and is utilized solely for the purposes of the Medicaid program.
· The commissioner is to report to the Governor and the Legislature, no later than one year after the effective date of the bill, on the implementation of retinal scanning pursuant to the bill, and is to include, at a minimum, in that report:
-- a detailed explanation of how the retinal scanning process was implemented;
-- the number of Medicaid applicants who have undergone a retinal scan for the purposes of the bill;
-- the costs, both incurred to date and projected, of implementing the scanning requirement;
-- an explanation of why any category of Medicaid applicants was excluded from the scanning requirement;
-- a detailed explanation of any significant technical, logistical, or administrative difficulties encountered in the implementation of retinal scanning;
-- a detailed explanation of how the data obtained from retinal scanning is being maintained and utilized; and
-- any recommendations that the commissioner desires to make concerning the use of retinal scanning for the purposes of the Medicaid program.
· The bill takes effect on the first day of the seventh month after enactment, but authorizes the commissioner to take anticipatory administrative action in advance as necessary for its implementation.
