Permits certain non-US citizen military service members to take civil service examinations and be eligible for civil service veterans preference.

An Act concerning certain military service members and civil service examinations and veterans preference, and supplementing chapters 4 and 5 of Title 11A of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. The Civil Service Commission shall permit an individual who is serving in the active military or naval service of the United States but who is not a citizen of the United States during such service, and who did not renounce or lose United States citizenship, to take an examination. That individual shall provide to the Civil Service Commission sufficient proof of United States citizenship no later than 10 business days prior to the issuance of an employment list in order to be included on that employment list.
The Civil Service Commission shall promulgate, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), rules and regulations and establish administrative processes that are reasonable, necessary, and consistent with the provisions of this act.
2. Any individual who was permitted to take an examination under section 1 of P.L. , c. (C. ) (pending before the Legislature as this bill) shall be eligible for designation as a disabled veteran or veteran for the purposes of Title 11A of the New Jersey Statutes provided that the individual was discharged or released under other than dishonorable conditions from military or naval service, would qualify as a disabled veteran or veteran as defined in N.J.S.11A:5-1 if the individual was a citizen of the United States at the time of discharge, and has provided to the Adjutant General of the Department of Military and Veterans Affairs sufficient evidence of the record of service and disability incurred in the line of duty, as appropriate, and received a determination of disabled veteran or veteran status, as appropriate. That individual shall provide to the Civil Service Commission sufficient proof of United States citizenship no later than ten business days prior to the issuance of an employment list in order to be included on that employment list and given disabled veterans or veterans preference.
The Civil Service Commission shall promulgate, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), rules and regulations and establish administrative processes that are reasonable, necessary, and consistent with the provisions of this act.
3. This act shall take effect six months following enactment, except the Civil Service Commission may take any anticipatory administrative action in advance as shall be necessary for the implementation of this act.
STATEMENT
Under current law, a person must be a United States citizen to take a civil service exam and to qualify for civil service veterans preference.
This bill permits an individual who is serving in the active military or naval service of the United States but is not a citizen of the United States to take a civil service examination and then be eligible for civil service veterans preference in certain cases.
Under the bill, an individual who is serving in the active military or naval service of the United States but is not a citizen of the United States during such service, and who did not renounce or lose United States citizenship, will be permitted to take a civil service examination. That individual must provide to the Civil Service Commission sufficient proof of United States citizenship no later than 10 business days prior to the issuance of an employment list in order to be included on that employment list.
The bill also provides that any such individual will be designated as a disabled veteran or veteran for the purposes of Title 11A of the New Jersey Statutes, Civil Service, if that individual was discharged or released under other than dishonorable conditions from that service, would have qualified as a disabled veteran or veteran as defined in Title 11A if a citizen of the United States at the time of discharge, and has provided to the Adjutant General of the Department of Military and Veterans Affairs evidence of the record of service and disability incurred in the line of duty, and received a determination of status. The individual must provide proof of United States citizenship no later than 10 days prior to the issuance of an employment list in order to be included on the employment list and given disabled veterans or veterans preference.
