     Authorizes executor or administrator to take control of online accounts of deceased person.

An Act concerning probate procedure and supplementing chapter 10 of Title 3B of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The executor or administrator of an estate shall have the power where otherwise authorized, to take control of, conduct, continue or terminate any accounts of a deceased person on any social networking website, any microblogging or short message service website or any e-mail service websites.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would allow executors and administrators to access, delete or administer online accounts of deceased persons.  The bill is based on legislation enacted in Oklahoma in 2010, and follows similar enactments in other jurisdictions. 

     It is the sponsor's intention to clarify that the executor or administrator is authorized to take necessary or permissible steps, which may include obtaining a court order, to access the contents of a decedent's online accounts.
