SYNOPSIS

     Permits marriage or civil union license to be obtained in any municipality in the State.

An Act concerning marriage or civil union licenses and amending R.S.37:1-3.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    R.S.37:1-3 is amended to read as follows:

     37:1-3  Where marriage or civil union license to be obtained.

     The marriage or civil union license shall be issued by the licensing officer in [the] any municipality [in which either party resides or, if neither party is a resident of the State, in the municipality in which] of this State, as long as the proposed marriage or civil union is to be performed in the State.

     2.    The Commissioner of the Department of Health shall adopt and promulgate such rules and regulations as are necessary to implement this act.

 

     3.    This act shall take effect immediately.

 

 

STATEMENT

 

     At present, N.J.S.A.37:1-3 provides that a marriage or civil union license can be issued by the licensing officer in the municipality in which either party resides or, if neither party is a resident of the State, in the municipality in which the proposed marriage is to be performed.

     This bill would permit a marriage or civil union license to be obtained in any municipality of this State, as long as the proposed marriage or civil union is to be performed in the State.

     The bill directs the Commissioner of the Department of Health to adopt and promulgate such rules and regulations as are necessary.
