SYNOPSIS
Requires collection of photo ID for sale of alcoholic beverages if purchaser appears under age 35.

An Act concerning the sale of alcoholic beverages, supplementing chapter 1 of Title 33 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. No person, either directly or indirectly by an agent or employee, shall sell, offer for sale, distribute for commercial purpose at no cost or minimal cost or with coupons or rebate offers, give or furnish, any alcoholic beverage without first verifying that the purchaser or recipient is above the legal age to consume alcoholic beverages by requiring the purchaser or recipient to produce a photographic identification card issued pursuant to section 2 of P.L.1980, c. 47 (C.39:3-29.3), or a similar card issued pursuant to the laws of this State, another state or the federal government; provided, however, the purchaser or recipient shall not be required to produce such a photographic identification card if the appearance of the purchaser or recipient is such that an ordinary prudent person would believe the purchaser or recipient was over the age of 35.
b. A person who violates the provisions of subsection a. of this section shall be liable to a civil penalty of $25 for the first violation, $50 for the second violation, and $100 for the third and each subsequent violation. The civil penalty shall be collected pursuant to the "Penalty Enforcement Law of 1999," P.L.1999, c.274 (C.2A:58-10 et seq.), in a summary proceeding before the municipal court having jurisdiction.
2. This act shall take effect on the first day of the third month following enactment.
STATEMENT
This bill requires any person or establishment that sells or otherwise distributes alcoholic beverages to require that every person attempting to purchase alcoholic beverages display a photo identification card to verify that they are above the legal age for purchasing alcoholic beverages, except if the appearance of the purchaser is such that an ordinary prudent person would believe the purchaser or recipient was over the age of 35.
The penalty for failing to check identification from an individual who appears to be under the age of 35 is $25 for the first violation, $50 for the second violation, and $100 for the third and each subsequent violation.
