SYNOPSIS
Protects law enforcement officers from liability when checking car seats.

An Act concerning law enforcement officer liability and supplementing P.L.1996, c.115 (C.2A:62A-1.1).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. A municipal, county or State law enforcement officer is not liable for any civil damages as a result of any acts or omissions undertaken in good faith, while on or off duty, in inspecting a child passenger restraint system or booster seat, as described in Federal Motor Vehicle Safety Standard Number 213, or its installation in a vehicle; provided, however, that nothing in this section shall exonerate a law enforcement officer for gross negligence.
2. This act shall take effect immediately.
STATEMENT
This bill would protect municipal, county, and State law enforcement officers from liability for any civil damages stemming from any acts or omissions in inspecting a child car seat or booster seat and its installation. The bill would apply to all law enforcement officers, regardless of whether they were on or off duty at the time. The bill also specifies that the liability protection is provided the acts or omissions were taken in good faith, and not the result of gross negligence.
