SYNOPSIS
Supplemental appropriation to DHSS for $7,453,000 for family planning services, and requires filing of State Plan Amendment to extend Medicaid coverage for family planning services to persons with incomes up to 200% of federal poverty level.

A Supplement to "An Act making appropriations for the support of the State Government and the several public purposes for the fiscal year ending June 30, 2012 and regulating the disbursement thereof," approved June 30, 2011 (P.L.2011, c.85).
Be It Enacted by the Senate and the General Assembly of the State of New Jersey:
1. In addition to the amounts appropriated under P.L.2011, c.85, there is appropriated out of the General Fund the following sum for the purpose specified:

Of the funds hereinabove appropriated for Family Planning Services, no monies shall be expended on abortion procedures.
2. In addition to the amounts appropriated under P.L.2011, c.85, the following language is added on page 113 of P.L.2011, c.85:

The Department of Human Services shall submit a State Plan Amendment to the federal Centers for Medicare and Medicaid Services to extend coverage for family planning services to persons with incomes up to 200% of the federal poverty level.
3. This act shall take effect immediately.
STATEMENT
This bill appropriates $7,453,000 in funding for Family Planning Services grants through the Department of Health and Senior Services which had been eliminated from the FY 2011 and FY 2012 appropriations acts and which has resulted in both the closing of facilities that provide family planning services and a reduction in the availability of such services. The bill specified that the monies cannot be used for abortion procedures.
In addition, the bill requires the Department of Human Services to submit a State Plan Amendment to the federal Centers for Medicare and Medicaid Services to expand Medicaid coverage for family planning services to persons with incomes up to 200% of the federal poverty level. Expansion of Medicaid family planning services would generate a 90% federal reimbursement and would make the provision of these services cost-effective from a State financial perspective. Available information is that the Medicaid program's existing appropriation contains sufficient funds to support any additional State cost associated with this expansion.
