An Act concerning 1[spotlights] vehicle spot lamps1 and amending R.S.39:3-53.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    R.S.39:3-53 is amended to read as follows:

     39:3-53.  1[Any] A1 motor vehicle may be equipped with 1[not to exceed] no more than1 one spot lamp 1,1 but the use of any such spot lamp for driving purposes is prohibited and every lighted spot lamp shall be so aimed and used so as not to be 1[dazzling] distracting1 or glaring to any person.  1[The limitation on the number of spot lamps set forth in this section] The provisions of this section1 shall not apply to 1[any]1 2authorized2 emergency 1[services] 2[service1]2 vehicles 2[1, including, but not limited to,1 law enforcement vehicles, ambulances, and official fire department vehicles]2 1, or to 2[vehicles used for a safety service patrol or emergency service patrol program operated by the Department of Transportation, a private entity under contract with the department, or through the use of a public-private partnership or demonstration project1] incident management response team vehicles or safety service patrol vehicles.

     For the purposes of this section:

     "Incident management response team vehicle" means a vehicle operated by the Department of Transportation or by a private entity under contract with the department which is equipped to respond at any time to assist the State Police with highway incidents.

     "Safety service patrol vehicle" means a vehicle operated by the department or by a private entity under contract with the department consistent with the provisions of subsection (m) of section 5 of P.L.1966, c.301 (C.27:1A-5), which is equipped to respond to highway incidents and provide assistance to motorists in disabled vehicles during designated hours in designated coverage areas in the State2.

     2.    This act shall take effect immediately.
